Property Access Addendum

This contract is between UpDog Gym (the "Business") and (the "Client") signed below.

To be used for clients who want to provide UpDog access to their home while they are not present. This is an optional service, and if you do not opt to schedule our services on a drop-in basis, these terms will not apply.

Terms

By agreeing to this Property Access Addendum to the Liability Waiver and Release, you waive or limit certain rights. Please read this contract carefully.

UpDog Enterprises LLC dba UpDog Gym (“UpDog”) offers mobile and on-site dog exercise sessions (“Activities”) with varying levels of owner involvement. If a dog owner requests, UpDog will enter the owner’s residence or other designated location (the “Premises”) to pick up and drop off an owner’s dog (the “Dog”). As a condition to UpDog accessing the Premises to pick up and drop off the Dog for the Activities, I agree that:

1. I am the owner or tenant of the Premises, or otherwise entitled to authorize UpDog staff to enter the Premises. The address I provided to UpDog staff is the correct address for the Premises. Should I need to change the location at which UpDog staff will pick up or drop off the Dog, I agree to provide notice of such change in writing in advance of the date and that the new location is subject to UpDog’s approval.
2. I have provided UpDog staff all information necessary to access the Premises. If I, or my representative, will not be present at the Premises when UpDog staff picks up or drops off the Dog, I have provided UpDog staff with a key or access code sufficient to access the Premises. I agree to disarm any alarm system prior to UpDog staff accessing the Premises.
3. The Premises are free of hazards, and to the extent there are any known hazards, I have notified UpDog staff of their nature and location sufficient to allow UpDog staff to avoid the hazard. Other than the Dog, there are no pets or animals at the Premises except as disclosed to UpDog staff in advance of the date of the Activities. No condition on the Premises is unreasonably dangerous. I agree to notify UpDog staff immediately if any new hazard exists on the Premises or if any condition becomes unreasonably dangerous.
4. I understand that UpDog reserves the right to discontinue its service of picking up and dropping off the Dog for the Activities for any reason, at any time. UpDog staff will contact me at the phone number and/or email address I provided if the service is discontinued.
5. I ASSUME ALL RISK OF INJURY, ILLNESS, DEATH, OR DAMAGE TO PERSON OR PROPERTY, WHETHER ECONOMIC OR NONECONOMIC, RELATED IN ANY WAY TO UPDOG STAFF’S ACTIVITY AT AND ACCESS TO MY RESIDENCE, INCLUDING ANY INJURY, ILLNESS, DEATH, OR DAMAGE TO PERSON OR PROPERTY CAUSED BY HAZARDS AT THE PREMISES.
6. I AGREE TO INDEMNIFY AND HOLD HARMLESS UPDOG AND ITS AGENTS, MEMBERS, MANAGERS, SUCCESSORS, AND ASSIGNS, FROM ANY AND ALL CLAIMS OF INJURY, INCLUDING DEATH, LOSS, COST, EXPENSES, OR DAMAGE TO PERSONS, ANIMALS, OR PROPERTY CAUSED BY THE DOG, MYSELF, OTHER PERSONS ACCOMPANYING ME, OR HAZARDS AT THE PREMISES RELATED TO OR ARISING IN ANY WAY FROM UPDOG STAFF’S ACTIVITY AT AND ACCESS TO THE PREMISES.
I understand that this Addendum is a part of the Liability Waiver and Release contract, and that this Addendum together with the Liability Waiver and Release contract and the exercise services agreement contain the entire agreement between me and UpDog and supersede any prior written or oral agreements concerning the subject matter herein and may only be modified in a writing signed by UpDog. In the event of conflict between this Addendum and the accompanying Liability Waiver and Release contract and/or the exercise services agreement, the terms most protective of and beneficial to UpDog will control.

By checking the box below and writing my name below, manual or electronic, (a) I acknowledge that I have read the above Liability Waiver and Release – Property Access Addendum and fully understand its contents, (b) I agree that this Property Access Addendum - Liability Waiver and Release is binding on me, my heirs, my legal representatives, successors, and assigns in accordance with its terms, and (c) I voluntarily agree to the terms and conditions stated above.
